Negligence at Illegal De-Addiction Center Leaves Minor in Critical Condition, Case Registered

haldwani Jaya Adhikari, wife of Anand Adhikari, resident of Vithoriya No. 1, Malli Bamori, Trilok Nagar, under Mukhani Police Station, Nainital district, filed a written complaint Mukhani Police Station.
According to the complaint, her 17-year-old son Shubham Adhikari was addicted to drugs and was admitted to the “Sankalp De-Addiction Committee” about two months ago for treatment. On the 21st, the complainant visited her son and found him in normal condition.
Later that day, she was informed that her son had become unconscious and was asked to rush to Sushila Tiwari Hospital. Upon arrival, no official or staff from the de-addiction center was present. Medical examination revealed severe damage to his kidneys and liver, and he is currently on ventilator support.
Police Action
Under the directions of Dr. Manjunath TC, Senior Superintendent of Police, Nainital, and supervision of SP Haldwani Manoj Kumar Katyal and CO Haldwani Amit Kumar Saini, the case was handed over to Sub-Inspector Avinash Maurya for investigation due to its gravity.
The probe found that the center was operating without registration and had illegally kept the minor under its care, showing clear negligence in treatment.
Based on this, FIR No. 50/26 under Section 125 BNS and Sections 87/108 of the Mental Healthcare Act 2017 was registered at Mukhani Police Station against accused Ayushi Kapil, daughter of Arun Kapil, resident of Khadkpur Isaai Nagar, Lama Chowd, under Mukhani Police Station.
